Trademark Symbol Law and Legal Definition
Trademark symbol, designated by ™ (the letters TM written in superscript style), is a symbol used to provide notice that the preceding mark is a trademark. The use of the symbols TM or SM is not governed by federal law. The symbols TM for trademark or SM for service mark are used to indicate the rights claimed to the trademarks without having federal registration. However, the use of the TM or SM trademark symbol does not mean a legally enforceable trademark.
